1. What you're buying

TenderPack generates the documents a South African public-sector tender submission needs: completed SBD forms, technical response, pricing schedule, B-BBEE preference points calculation, and compliance matrix. We do not guarantee you will win the tender. We guarantee your pack passes admin compliance, so you compete on price and capability, not paperwork.

2. Who can use TenderPack

• You must be at least 18 years old.
• You must have legal authority to bind the business you're bidding on behalf of.
• Built for South African tenders. Not designed for or warranted outside South Africa.

3. Your responsibilities

You agree to:

1. Provide accurate information in your company profile (CSD number, B-BBEE certificate details, tax compliance status).
2. Review and sign the generated SBD forms yourself. TenderPack will not sign on your behalf.
3. Submit packs through the official procurement channel (eTenders portal, departmental SCM office, etc.) yourself, unless you're on the Concierge plan.
4. Not use TenderPack to submit fraudulent declarations or misrepresent your company.

4. Our responsibilities

We will:

1. Generate technically accurate SBD forms based on your profile.
2. Flag any expired certifications (B-BBEE, TCS PIN, CIDB grade) before you submit.
3. Refund a month's subscription if a pack fails admin compliance (see section 5 and our Refund policy).
4. Keep your data secure and POPIA-compliant (see our Privacy notice).

5. The TenderPack Promise

If your pack fails admin compliance (meaning the procurement officer rejects it for paperwork reasons, not price or technical scoring), we credit your next month free (Bidder / Contractor) or refund the pack fee in full (Single Pack / Concierge). To claim, email us the rejection notice within 7 days of receipt. See the Refund policy for the full process.

6. Pricing and billing

• All prices are in South African Rand (ZAR), exclusive of VAT unless stated.
• Subscription plans (Bidder, Contractor) renew monthly until you cancel.
• Single Pack and Concierge are once-off, per-tender purchases.
• We accept EFT, debit order, and card. No conversion fees, no USD billing.
• Failed payment: 7-day grace period, then access pauses until paid. Your data is not deleted.

7. Cancellation

Cancel any time from your account settings or by emailing support@tenderpack.co.za. No cancellation fee. You keep access until the end of the current billing period. Every pack you've already downloaded remains yours forever. The ZIP works without our service.

8. Data ownership

You own the contents of your company profile, your RFPs, and your generated packs. We process them under your instruction. We do not train AI models on them. We do not share them. See the Privacy notice for details.

9. Acceptable use

Do not use TenderPack to:

• Submit fraudulent or knowingly misleading bid information.
• Process tenders on behalf of sanctioned entities.
• Reverse engineer the service or scrape our content.
• Resell the service without a written agreement (Concierge and Agency plans excepted).

10. Liability

TenderPack is provided "as is". Our maximum liability is the total amount you have paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost tender awards. Nothing in these terms excludes liability for fraud, gross negligence, or anything else that cannot be excluded under South African law.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg, unless first resolved by mediation under the rules of the Arbitration Foundation of Southern Africa.

12. Changes

We will email active account holders at least 14 days before any material change to these terms. If you don't agree, you can cancel and export your data before the effective date.
